PETITION FOR CANCELLATION OR CORRECTION OF ENTRIES IN THE CIVIL REGISTRY

Generally, correction of clerical errors in NSO birth certificates and other relevant records can be done only by filing a petition in court. The NSO gives us guidelines on how to go about it. You can read through these steps:

TEN steps to be undertaken in the correction of an entry in a civil registry document

  1. Contact a lawyer who will prepare the Petition for Correction of Entry.
  2. Lawyers shall file the Petition in the Regional Trial Court. The fee for filing the Petition in the Regional Trial Court is Php 160.00.
  3. The Petition will be raffled and assigned to a branch of the Regional Trial Court.
  4. The assigned Regional Trial Court shall issue an Order for the publication of its Order in a newspaper of general cirsulation for three consecutive weeks. Fee for publication varies.
  5. The Order contains the date of the first hearing.
  6. During the first hearing, the lawyer will present compliance of the jurisdictional requirements like publication of the Order in a newspaper of general circulation.
  7. After establishing compliance with jurisdictional requirements, the petitioner will be presented in Court to testify. The Court may assign the Clerk of Court to receive evidence.
  8. During the hearing, it is possible that an oppositor may appear contesting the Petition. If an oppositor appears, the Clerk of Court will receive the petitioner’s evidence.
  9. After presentation of evidence, the Court will rule on the Petition.
  10. If the decision is favorable, the Court will order the Office of Civil Registrar to correct the entry in the civil registry document (birth/marriage/death certificate of the petitioner).

    • You may file it in baguio, and it will be a migrant petition. You may also file it in pampanga, because eventually it will be transmitted there for processing. I suggest to file it in Pampanga directly.

    • Magandang araw po Den. Una sa lahat, kailangan po natin matukoy ang tunay na “status” o kalagayan ng kasal ninyo noong panahon na isinilang ang inyong mga anak; kung valid ba o hindi ang kasal. Bagaman hindi nakarehistro ang “marriage certificate”, hindi sumusunod na “Void” na agad ang kasal ninyo.     Hi! Would like to inquire if this situation can be done in the local civil registrar or regular court? In the birth certificate of my son, it stated date of marriage with my ex-boyfriend, even though we were not civilly married. We were just live-in partners for two yrs.

    • Hi Angel, you may use the surname of your biological father. However, you will need to execute an Affidavit to Use the Surname of the Father (AUSF).       Filing fee po ay 1000. Magdala rin po ng supporting documents na nakasaad doon ang tamang place of birth

    Hi, this is Lynn. How do I go about the following errors? I found out from the municipal records of Ginatilan, Cebu that the spelling of my husband’s middle and last names are incorrect. Instead of “u”, it is spelled as “o” so with the last name of his father. The name that appeared also for his mother was her maiden name instead of her married surname. Are these to be filed in RTC? or just can be corrected in our local civil registry office in Cebu City? Do I have to file it in one petition only as it appears only in his birth certificate?     • For the typographical errors, your husband needs to file its correction in the local civil registry where he was born. No need to file it in court. One petition can contain both errors. Processing takes 3-4 months from the time of filing. Filing fee usually costs P1000, but check with them. They might charge more since there are two errors.

    good day po.last week po dumating na po yung NSO ko via delivery kaso lang po yung buong pangalan ko po ay walang JR. I came from a broken family ang tita at tito ko nlng po ang nag adopt sa akin since nung baby pa ako. unfortunately since nag aral ako may JR na ako sa pangalan ko kahit sa mga ID ko (SSS, PHILHEALTH, at iba pa ) kahit sa passport ko ay may JR.     • File for change of first name in cebu (place of birth). You will need to submit supporting documents, such as school, employment records, NBI/Police Clearances, baptismal certificate, valid government IDs.

      Filing fee is P3000. Publication fee is around P2000.

    • For the second name of the child, you need to file a petition for change of first name in the place where he was born.

      To remove the father’s name, you will need to file this in court.

    Good morning, I have a problem on my Birth Certificate. I have been using “Genevive” as my first name and all my documents used also the name “Genevive”.. But on my actua Birth Certificate, the name stated on the record is “Geneveve”

    What are the documents I need to prepare in processing correction of my name on my birth certificate?

    Can somebody (like my father) coordinate / process this concern or request with the NSO?

    Currently, I have “Affidavit” showing that the name “Genevive” and “Geneveve” refers only to the same person, and I am that person. The affidavit was created year 1992 at San Fernando Pampanga.

    With the current document I have,
    1. Birth certificate with “Geneveve” as my first name
    2. Affidavit record stating “Genevive” and “Geneveve” is the same person.

    Can I use these documents in processing a passport?

    • You may file a petition for correction of clerical error in the place where you were born, not in the NSO. For supporting documents, submit IDs, school, employment records, baptismal certificate, etc, which reflect the correct spelling.

      The Affidavit you described is no longer accepted as an acceptable document in place of the birth certificate.

      Your father can facilitate this on your behalf. Just issue a special power of attorney in his favor.

    • THis needs to be filed in court. In the place where he was born. You will need to hire a lawyer to represent him in court. The total cost will mainly depend on the lawyer’s legal fees.

    I would like to ask if how long it would take before i can able to get my marriage contract at the NSO with a correction.?
    I been filled my petition last march 2012. Then the Civil registrar here in Dipolog city Sent it to Manila NSO last April 11, 2012. So i would like to know when exactly i can able to get my marriage contract with correct at the NSO office here in my town. I am the petitioner of my marriage contract clerical error. I already done paying the money order at the post office sending to NSO QUEZON CITY last May 21, 2012. Why is it until now i keep going back at the NSO DIPOLOG City to check it but i still did not get my marriage contract with the correction. I do really wanna know when exactly because i badly needed my marriage contract as soon as possible so that i can start processing my spousal visa going to UK. I am waiting for few months already and i still did not get it. What should i do to get my marriage contract with correction as soon as possible?

    • A petition for correction of clerical error usually takes 3-4 months from the time of filing. Even more if it is a migrant petition. You have to check with the Quezon City Civil Registrar if they have received your document, using the receipts you paid in Dipolog City.

    magtatanong lang po ako regarding sa first name ko sa birth certificate, and first name ko po sa birth certificate ko is Marian Mark, pero ang ginamit ko po since na nag aral ako ng kinder is Marion Mark, one letter lang po ang papalitan, kaya po pala nung kumuha ako ng NSO yun po ang lumabas, hindi po ako maka pag apply as seaman dahil lang po sa NSO ko, anu po ba ang right process? kasi nagpunta na po ako sa City hall of manila and they give me a requirements, after ko po macomplete lahat, there is a target fee na sinabi sakin which is ranging P5,000 to P8,000, pahingi naman po ng advise about my problem, kasi isang letter lang naman po ang papalitan then i have to pay that much for that one letter.

    • It is the Manila Civil Registrar Office who determines what procedure needs to be followed. And as we see it, they decided that it will be a change of first name. Even if only one letter will be corrected. Based on our experience in Manila, the total amount to be paid ranges from P5000-P6000. Ask for receipts for every step, so you are sure you are paying the right amount.

      It takes 4 months from the time of filing before the petition is approved.

    • As far as we know, the expenses will amount to around P5,000 for a petition for change of first name.

      Just remember to ask for an official receipt at every step, so you are assured that you are paying the correct amount.

    • A new law now allows the correction of gender entry in the birth certificate in the local civil registrar. No need to hire a lawyer and file this in court. However, you will need to wait for its full implementation.

    • If you can show proof through your parent’s birth certificate, or that of your siblings that the correct name is De Rueda, then you can file it as a correction of clerical error which may be filed in the place where you were born.

    • If we may ask, what are the documentary proof that reflect your mother’s name as “Generosa Francisco Raagas”? This might not be considered as a clerical error by the civil registrar, especially if they think these two names are in fact two different persons.

      If a court case is filed, your presence will most likely be required

Ganito yun two times po akong pina register ng mother ko first sa surname ng father ko and then di sila kasal kaya pina register ako ulit sa surname ng mother ko mismo.     Thanks goodness for this site. I have been looking for something like this for the past two years.

    I enrolled as a nursing student and i haven’t been able to submit my nso birth certificate to the registrars office. I wasn’t able to enroll this semester because of this. I have been using sept 27, ’86 in all my documents. passports, school records, marriage certificate and my kids birth certificates. the place of birth is in lingayen pangasinan. I was able to request a copy of this at the local municipal of lingayen pang but nso has no record of this. I called nso to request for an authenticated birthcert. what they have on file is 0ct9,’86 place of birth at bocaue bulacan. My mothers name on this certificate is also incorrect. her maiden name is lorna dalisay but they have it as lorna diaz.

    I was really born in bocaue and my birthday really is oct 9. but since all my documents use the sept 27 bdate I would like this to be the one registered with nso. How do i get rid of the oct 9 birth certificate. Thank you.

    A boy was born to an American father and Filipino mother out of wedlock and former uses the surname of his Filipino mother. The mother later married a Canadian. This Canadian acknowledged the child. The child’s surname was changed to the Canadian’s surname (BC annotated through RA 9255).

    The mother undertook the application of the child to become a permanent resident of Canada. The Canadian Embassy in Manila, however, discovered that the mother divulged the real name of the child’s father (the American and not the Canadian) in her previous application.

    The child’s application is on hold.

    The mother and her Canadian husband tried to adopt the child through inter-country adoption but the adoption agency would not work on it unless the child’s BC is restored/corrected.

    The child is 6 years old and left in the Philippines under the care of his grandmother?

    What is the remedy??? Cancellation of entry? Cancellation of the BC? Domestic Adoption?

    Please help this child.

    hELLO.. I went to our municipal civil registry office in Mariveles, Bataan to file a clerical error on our marriage certificate last Oct. 22, 2012. We already paid the amount of Ph 1,700.00 but there was no O.R. given to us because the person in-charge for the said documents was not around. According to the person we talked to, & who received our payment, he cannot issue us the OR yet because the O.R. should match with the application date of our petition. He advised us to just txt him & ask if the person who is in-charge for the correction is already at their office. I want to know how long it will take to process the said MC clerical correction? And if still there is nobody to sign & processed our papers where do else we go? I badly needed our MC because I have to apply SSS & Passport. But for the inconvenience they’re giving us, it will took me (i guess not only me but also the other who has the same clerical problem as ours) impossible to process our other important documents. Any advice is very much appreciated. Thank you.

    Hi, my question is on behalf of my boyfriend. His problem with his NSO birth certificate rendered him unable to take the ECE Board Exam.

    His NSO birth certificate showed his name, but all the rest of the information was not his, but his older brother’s. He was able to request for a corrected version but he used this to process for his passport and failed to keep a copy for himself (he also failed to claim his passport after). When he requested for another copy, he was given the “uncorrected” version (the one that had his name, but his brother’s information).

    We are now waiting for his brother’s NSO birth certificate to check if his contains my boyfriend’s information. In the event that their information got interchanged, how do we go about this? do we need to go through a court? If yes, would you happen to know how much this will cost him?

    hello po, may problema po ako sa birth certificate ng anak ko. 2 po kasi ang nakarehistro sa nso ang una po ay puro mali.mali ang entry ung last name nya ay kinuha sa father nya pero mali parin tapos may date of marriage pa hindi naman kami kasal ng ama nya. single mom ako. college palang ako nagka bb at hindi kami nagkatuluyan ng ama ng anak ko. at hindi ako ang nag fill-up ng bc ng anak ko sa time ng nanganak ako isang kaibigan lang. pero b4 ko inapply ang late registration ng anak ko nagcheck po ako sa local registry kung may naka rehistro na, since wala so i apply for late registration. now ng mag-aral na anak ko at kumuha ako sa nso nagulat ako dahil mali ang bc na ibinigay sa akin. ang ginagamit ng anak ko ay ang late registerd na bc nya. kung aapply ako ng petition for cancellation of the first birth certificate gaano po ba katagal aabotin at magkano po ba ang gagastusin? kailangan ba sa local registrar talaga magfile ng petition?

    na-doble po kasi ang pag-register ng BC ko, this happened nung 1992 when our family was arranging our papers for migration to Australia, sbi ng parents ko hindi daw po ako naregister nung 1980 (year of my birth) so ang ginawa nag late registration po cla at naayos naman po ang registration ko sa makati. (fyi, hindi po kmi natuloy for migration). then last week lang po when i was applying for a passport, hindi po inaccept ng DFA kc wala po nakalagay na place of birth & advised me na aayusin sa makati city hall para malagyan ng supplemental report, then dun sa makati po nalaman na nadoble ang registration ko. yung NSO BC ko po is registered march 1980 & another problem is wala daw po copy ang makati ng BC ko nung March 1980. the only record na meron sila is yung 1992 (late registration) pinakita po sa akin yung file nung 1980 & wla po talaga. anu po kaya ang dapat ko gawin? i really need the passport kc meron po ako application for work sa abroad

      If the NSO has a birth certificate, dated MArch of 1980, then a local civil registrar surely must have endorsed it to the NSO. We have to determine where that Birth certificate originated from and why the Makati LCR only has a record of your late registration.     do we still need to have the marriage contract of my parents corrected if my dad’s middle initial is wrongly entered as letter “P” instead of letter “G”? This is what we got from NSO but the other documents like baptismal, senior’s citizen, voter’s and certificate of negative record in nso shows letter G.     Yung case ko po ay masyadong kumplikado. wala po akong record sa NSO. then when i trace it in the local civil registry where i was born, i found out na i was first registered with a different name and different gender and my fathers name and surname was also spelled incorrect together with my surname. Yung first record po n un ang naka file sa NSO. pero meron po akong nakuha birth certificate na nakalagay ung correct name I am using but with mispelled surname and the same name entry of my father with the previous record. pano po ang gagawin ko to correct all of these. I need to have my NSO for passport processing.

    gud day po atty. matagal ko na po ni re-request from nso ang bc ko na paranaque pero negative po. hinanap ko din po yun bc ko sa paranaque ct hall pero negative din po. dahil po puro manila ang nakalagay sa mga docs ko such as baptismal at school records, nagfile po ako ng late reg sa manila ct hall dahil sabi rin po ng mama ko wala rin siya mahanap sa paranaque. sa tulong po ng birth cert ko na manila nakapagpa=passport at renewal din po ako. last time ako kumuha is 2006. nag-late reg po ako sa manila 1999. just recently lang po this monday lumabas na po yung matagal ko na hinahanap na paranaque. ang sbi po sa akin sa nso kc daw po nung last time ako kumuha ng secpa tsaka pa alng nai-forward ng lcr yung birth ko sa paranaque. ngayon gagamitin ko sana yung paranaque sa passport ko d nila accept kc i-cancel ko daw muna ang isa bago nila issue sa akin passport. tanong ko lang po months po ba aabutin ang pagpa-file?kasi po yung proof lang daw po na nag-file na ako ng case sa lcr to cancel yung birthplace ko. sana masagot nyo po ako kasi 3 months lang din po validity ng cert of eligibility para po sa visa ko.

    Inquire lang regarding my situation and the steps i need to do:

    I requested my NSO Birth Certificate last month. Ang inissue nila na spelling ng name is “May” and born in Quezon city daw. But last 2008, ang inissue nila is “Mae” and born in Meycauayan. But from birth until now (baptismal, passports, prc, sss, tin) etc ang gamit ko is ung inissue nila last 2008 “Mae”.

    Found out from my mom na sa QC talaga ako pinanganak but nilate register nila ako sa meycauayan. (dunno why)

    Then per inquiry ang irerelease nalang daw ng NSO is ung birth certi na from QC since double registration daw ako.

    Problem almost all transactions sa government requires a birth certificate and wala na ko makuha na “Mae” ang name. what should i do?

    called NSO sabi nila request ko daw pacancel ung birth certificate sa QC para irelease ung sa meycauayan will this work?

Aug 15 ,2014 po ako nkapag filed ng petition for correction of clerical error.ang aking case po is tampered daw po ang k sa name kong krisel. Crisel dw po ang nasa record ng LCR BAGUIO at tinampered lang n K.pero ang original LCR ko po, baptismal at lahat ng school records and other supporting docs ay “krisel” ang gamit ko.

    Hi. I have a very rare case. Can I apply for a passport even without my mother’s name in my Birth certificate or get a US visa without it? My father and mother separated when i was in grade 2. I am married now and uses my husbands surname. But me and my mother didn’t have communication since grade school. So when my father filed for a delayed registration for me when I was in high school he didn’t include my mother’s name because he wasn’t sure what was her full name. So he uses his middle name also as my middle name. SO me and my father has the same middle and surname.     hi po gusto ko po humingi ng advise about my birth certificate. dalawa po kasi ung lumabas na birth certificate ko pero both of it except sa pangalan ko ay totally magka iba ang details ung late register na birth certificate ko na nakablock na ngayon ang gamit ko mula 1996 at sa japan na po ako nag aral at until now nandito padin po ako sa japan.
